Prenatal sex determination tests are illegal in India. Anyone who advertises for the same and the one who displays such advertisements in India will also be considered doing an illegal activity in India.
Does that mean if you purchase a newspaper in India, could be any, even a copy from a Thailand local newspaper, if carrying any such advertisement, the seller here can be prosecuted?
If that is true and is effectively covered within the law, then the demand of Brinda Karat, a CPI-M leader against Google India, holds strong ground. Brinda has allegedly Google for hosting advertisements about clinics doing prenatal sex determination tests that are in violation of laws.
If a case gets registered against Google India, it would be interesting to see the court judgment here, since it will not only reflect the seriousness of the law makers but also determine the freedom in the online space available to Indians..
